RSTP2017 - Complying with an information notice

RSTPA guidance on complying with an information notice.

If you are required by an information notice to produce a document you must do so:

  • at a place agreed to by you and us; or
  • at such place as we may reasonably specify (which must not be a place used solely as a dwelling).

The production of a document in compliance with an information notice does not break any lien (a form of security interest granted over an item of property to secure the payment of a debt or performance of some other obligation) claimed on the document.

You can comply with an information notice by providing a copy of the document, unless the information notice requires the original to be provided or, after the notice is given, we later make a request for the original to be provided. If the latter applies, then the document must be provided within such period and time and by such means (if any) as we reasonably request.

If you fail to comply with an information notice, or any requirement contained in a notice, you are liable to a penalty (see RSTP3015).

If, in complying with an information notice, you carelessly or deliberately provide inaccurate information or produce a document containing an inaccuracy, you are also liable to a penalty (see RSTP3018).

It is a criminal offence to conceal, destroy or otherwise dispose of a document (or arrange to do so) which is, or may be, the subject of an information notice approved by the tribunal.

Alternatively you may be liable to a penalty for concealing, destroying or otherwise disposing of a document (or arranging to do so) which is, or may be, the subject of an information notice (irrespective of whether or not tribunal approval has been obtained or will be sought).
